I need help with Michigan gun laws

The country that avoids war and the country that fights but has a hard time winning have been combined. The Swiss made some excellent firearms and the French made some unique and occasionally inspiring ones. We have added the Belgian and Dutch since they are neighbors.

I need help with Michigan gun laws

I'll be moving to Macomb county Michigan from Virginia soon and I need advice on negotiating the gun laws there. The Gun Law outline on the NRA website helps me some. If that information is right, my long guns, including my 1935 K-31 do not need to be registered. However I have a small collection of handguns as well which according to the NRA must be registered. Which is OK. Virginia has no restrictions except the NIC and a "One gun a month" law. But I know it's not the same everywhere. I am more than happy to follow the laws that Michigan has enacted. I just need some real world guidance on how to do that.

Unfortunately, all pistols must be registered in Michigan, unless they are to remain in storage and not used.





There are no special laws on long rifles, and as a trade off, we have no one gun a month rule. Private transaction require no paperwork, unless a 03 FFL is involved, for example. I've purchased as many as 4 rifles at one time and the NICS gave the go ahead<!--EZCODE EMOTICON START :) --><img src=http://www.ezboard.com/images/emoticons/smile.gif ALT=":)">;

The link Plantfoam has is a good one. The "Gun Laws in Michigan" PDF file is what you need to look at long and hard.





Some of the oddities:





1. Michigan has a requirement for a pistol/handgun permit to purchase (a small set of 3 green cards) which one is supposed to get before acquiring a pistol. There is not a provision in this statute for John Q. Average bringing pistols/handguns into the State that he acquired in his previous State of residence, but most Police Departments will give you little trouble. If I can make a suggestion, write (NOT Telephone) a nice letter to the the Director of the State Police (address him as "Colonel")

Ask him what you should do. Since the State Police tell local Police Departments how to administer permits to purchase and licensing of pistols, going in to your local police on arrival with a letter from State Police telling you (and them) what to do, you will be golden. If you are moving to a City, the City Police will handle matters. If you are moving to a Township which has a Police Department (most do not), you will need to talk to that Township Police. For all other non-City locations, talk to the County Sheriff.





2. Michigan pistol/handgun registrations are on another green three-part form entitled "Safety Inspection Certificate." The one of those three parts that you keep is a permit to take your pistol to the range or hunting, after unloading and casing to transport it. It also is your license to possess it at home.





3. In my childhood in Virginia, if you were carrying a firearm such as a rifle that was visible, you could carry as many firearms concealed as you wanted with no special permits. Not in Michigan. To hunt with a handgun/pistol you need to have it on the outside of your clothes if you do not have a Concealed Weapons Permit. If you do not have a CCW, you should have your green card. If you have a CCW card with you, you need not have your green card.





4. Non-Federal Curio or Relic Short barreled rifles are always illegal in Michigan, even if Federally registered, and folding stock rifles over 26" but under 30" with the stock folded have to be registered as a handgun/pistol.





5. Concealed Weapons Permits are not hard to get any more, it is just a little time consuming.





6. Transport firearms unloaded, cased, and inaccessible.

Now, I was under the impression that we <!--EZCODE ITALIC START--><em>DID NOT</em><!--EZCODE ITALIC END--> register handguns in Michigan. After purchase, they need to be "Saftey Inspected" to be used at a range or for a CPL.. If you purchase one on an 03FFL, the only rason for the "Safety Inspection" is as stated above.

Perhaps its not techally a "registration," but they keep your info on file at the state police and local police. In my opinion the "safety inspection" is a load of crap, its just an excuse to verify the info that you report on the green card. At my PD the civilian clerks just check your serial numbers. Some safety inspection.

I'm a little sore about this law; my local PD only does handgun busineess from 9 to 4 on Tuesdays and Thursdays, so I have to make special arrangements to visit them.

Not all handguns must be registered in Michigan. Those that do not essentially must be ones you do not intend to fire. See MCL 28.422(7). If you have ammo to fit a handgun, you better register it.

Anyone who believes the "Safety Inspection" is not registration should see MCL 28.429(1).
